CLC 2020 142 · Balochistan High Court
This case involved a dispute over agricultural land in Mastung, Balochistan. The petitioners claimed they were the rightful owners of certain land, both settled and unsettled, based on ancestral possession, purchase deeds, and old land grants (sanads). They filed a suit seeking a declaration of ownership, a permanent injunction against interference, and correction of revenue records. The trial court dismissed their suit, and on appeal, the appellate court partly allowed it only regarding the settled land, not the unsettled land. The petitioners then challenged this outcome before the Balochistan High Court.
The High Court upheld the lower courts' decisions and dismissed the petitioners' case. It found that the land mutation had been carried out back in 1962-64 in the presence of the petitioners, who raised no objection at the time and effectively accepted it. Since they waited more than fifty years to challenge it—far beyond the six-year limitation period for declaratory suits—their claim was time-barred. The court also noted they failed to explain this long delay or provide strong evidence proving ownership of the unsettled land. Under the law, unclaimed forests and wasteland are presumed to belong to the government unless proven otherwise.
This judgment reinforces two important legal principles: parties must challenge property records promptly, and unsettled or waste land is presumed government property unless private ownership is clearly established through solid evidence.
