Gulzar Khan V. Mst. Rahima and 3 others,

CLC 2020 1340 · Balochistan High Court

This case was about a custody dispute between a father, Gulzar Khan, and a mother, Mst. Rahima, over their three children after their marriage broke down. The father had filed an application seeking custody of his two sons and one daughter. The trial court gave him custody of the two boys but ruled that the young daughter, aged about five, should stay with her mother until she reached puberty. The father appealed this decision, and when the appeal was dismissed, he brought the matter to the Balochistan High Court.

The High Court upheld the lower courts' decisions and dismissed the father's petition. The judges explained that under Muslim personal law, a mother is entitled to custody of her daughter even after puberty until marriage, while a father can only claim custody of sons after they turn seven. The court stressed that the welfare of the child is the most important factor in custody cases, including their mental, emotional and intellectual development. Since the father worked as a contractor and was frequently away from home, he could not show who would care for the young girl in his absence. The court also noted that a mother's limited financial means does not disqualify her from having custody, and that a mother's bond with a young daughter is especially important for her upbringing.

This case highlights how Pakistani courts prioritize children's overall wellbeing, guided by Islamic family law principles, over a parent's financial status when deciding custody matters.
