CLC 2020 1334 · Balochistan High Court
This case involved a long-running family property dispute in Quetta over a house at Satellite Town. Years earlier, a widow's suit claiming sole ownership of the house was dismissed, and that decision was upheld all the way to the Supreme Court. Later, other family members (the petitioners) successfully sued for partition and possession of their Sharia-based shares in the same house, which was recorded in court records as measuring 5400 square feet. This partition decree was also upheld through the appellate courts and Supreme Court.
When it came time to actually divide the property, the decree-holders discovered that the house's real area, according to the original allotment order from the Quetta Development Authority and the site plan, was actually 7065 square feet, not 5400 as mistakenly written in the earlier court papers. They asked the court to correct this clerical error under Section 152 of the Civil Procedure Code, but the executing court refused, and the family brought the matter to the Balochistan High Court.
The High Court ruled in favor of the petitioners, holding that since ownership shares had already been conclusively settled, the wrong area figure was simply an inadvertent mistake that could and should be corrected to match the official allotment order, which was the true foundation of ownership. Citing Supreme Court precedent, the judge allowed the correction, subject to verifying the area against the allotment order. This matters because it confirms that courts can fix honest factual errors in decrees without reopening settled ownership rights.
