Maqbool Ahmed and others V. Secretary, Revenue Department, Government of Balochistan and others,

CLC 2020 1151 · Balochistan High Court

This case was about the renaming of two places in Balochistan - Mangochar Sub-Division in District Kalat was renamed Khaliq Abad Mangochar, and Tehsil Phelawagh in District Dera Bugti was renamed Tehsil Qadirabad, through government notifications issued in 2014 and 2018. Local residents challenged these renamings in the Balochistan High Court, arguing that the government had no legal authority to change the historical names of these places, that the changes seemed aimed at honoring political families rather than serving public interest, and that no public consultation or objections process had been carried out before the names were altered.

The High Court agreed with the petitioners. It found that the Balochistan Land Revenue Act, 1967, which the government cited as its basis for the notifications, contained no provision actually allowing the renaming of a district or tehsil. Since there was no law empowering the executive to take such action, the notifications were declared illegal, without lawful authority, and void from the start. The court restored the original names.

The judgment also clarified important constitutional principles: courts can intervene when public officials act beyond their legal powers, even if the challenger doesn't have a strict personal legal right, as long as they have genuine public interest at stake. Government policies can be reviewed by courts if they violate the law or fundamental rights. This case matters because it reinforces that public authorities must act strictly within powers granted by law, and arbitrary administrative decisions affecting communities can be struck down when no legal basis supports them.
