Lal Jan V. Kamalhan and others,
CLC 2020 1090 · Balochistan High Court
This case comes from the Balochistan High Court and concerns a claim of pre-emption, a right under Islamic law that lets certain people (such as neighbors or co-sharers) step in and purchase property when it is sold, ahead of other buyers, provided a valid sale actually took place.
The petitioner, Lal Jan, claimed that Kamalhan had purchased land from another person and that he had a preferential right to acquire that land instead. He said he learned of the sale through a witness and then followed the proper legal steps to assert his pre-emption claim. The respondents denied any sale occurred, insisting the land had only been leased (Ajara) for seven years, not sold.
The trial court dismissed the suit because the petitioner failed to prove a sale had actually happened. On appeal, the High Court agreed. It explained that pre-emption rights only arise from a genuine, complete sale, not from leases, gifts, inheritance, or similar arrangements. The witnesses presented by the petitioner had no direct knowledge of any sale; their testimony was based on hearsay, which the law does not accept as valid evidence. Since no direct, admissible evidence of a sale existed, the core requirement for pre-emption was missing.
The High Court therefore dismissed the appeal, upholding the lower court's decision. The case highlights that courts require solid, direct proof of a sale before granting pre-emption rights, and secondhand information is not enough.
