CLC 2019 316 · Balochistan High Court
This case concerns two trade associations in Balochistan that challenged a federal law and rule governing elections of trade organizations and chambers of commerce. Under the Trade Organizations Act 2013 and its accompanying rules, new members of a chamber or trade association must wait two years after enrolment before they can vote in elections, while old members who re-register after a lapse only need to wait one year. The petitioners, who had recently obtained their trade licences, argued this two-year waiting period was discriminatory and violated their fundamental right to equality under Article 25 of the Constitution, especially since it would prevent them from voting in an upcoming election where, by rotation, Balochistan was due to have representation.
The Balochistan High Court dismissed the petitions. It held that courts must exercise judicial restraint when reviewing policy matters, and that under Article 30(2) of the Constitution, laws cannot be challenged merely on grounds of policy. The court also explained that Article 25's equality guarantee allows reasonable classification, meaning people in different situations can be treated differently, and persons similarly situated are to be treated alike. Since new and old members are not identically situated, the differing waiting periods were a valid classification rather than unconstitutional discrimination. The law was presumed constitutional, and the petitioners failed to show any clear violation of constitutional principles.
This case matters because it illustrates how courts balance individual rights claims against legislative policy choices, reaffirming that not all differential treatment amounts to unconstitutional discrimination.
