CLC 2019 261 · Balochistan High Court

This case concerned a man whose nomination papers for Balochistan's Provincial Assembly election in 2013 (constituency PB-46 Kharan) were rejected by the Returning Officer, a decision later upheld by the Election Tribunal. The rejection was based on findings that in the 2002 general election, he had falsely declared possession of a Bachelor's (BA) degree, when in fact he had failed his BA examination at Punjab University. Investigation at the time revealed that his answer sheets had been tampered with during a rechecking request, leading a university disciplinary committee to bar him from taking exams for three years. He never challenged that disciplinary ruling. Instead, he later took and passed a BA exam from the University of Balochistan in 2006 under a different roll number.

The petitioner argued that since the 2002 election petition against him was withdrawn without a final decision on merits, and since no objection was raised when he contested in 2008, the old findings should not be used against him in 2013.

The Balochistan High Court disagreed. It held that his failure to challenge the disciplinary committee's decision meant it stood as final, and his repeated reliance on a false claim of holding a BA degree showed he was not "honest, righteous, and Ameen" as required by the Constitution for contesting elections. The court dismissed his petition, upholding rejection of his nomination papers. The case underscores that candidates making false educational claims can be permanently disqualified, regardless of later unrelated qualifications.
