CLC 2019 2057 · Balochistan High Court

This case is about a land dispute in Kharan, Balochistan. Two brothers (respondents) claimed ownership of land called Cheedai, saying it originally belonged to their maternal grandfather, was gifted to their mother, and then passed to them. They sought a court declaration confirming their ownership and cancellation of a conflicting land mutation record, plus a permanent injunction. The trial court initially dismissed their suit, but after an appeal and remand, dismissed it again. The brothers appealed again to the Majlis-e-Shoora (appellate forum), which this time ruled in their favor and reversed the trial court's decision.

The losing party then challenged this appellate decision before the Balochistan High Court. The High Court found that the appellate court's judgment was legally flawed because it failed to follow mandatory procedure under Order XLI, Rule 31 of the Civil Procedure Code. This rule requires an appellate court to clearly identify the specific points in dispute, give its decision on each point, and explain its reasoning—especially when reversing a lower court's ruling. The appellate court had not done this, and had also failed to rule on the specific request to cancel the land mutation.

Because of these gaps, the High Court set aside the appellate court's judgment and sent the case back for a fresh decision that properly follows the required legal procedure. This case highlights the importance of appellate courts providing clear, reasoned judgments rather than simply reversing decisions without proper analysis.

ہارنے والے فریق نے اس اپیلی فیصلے کو بلوچستان ہائی کورٹ میں چیلنج کیا۔ ہائی کورٹ نے قرار دیا کہ اپیلی عد
