Balochistan University of Information and Technology and Management Sciences, Quetta V. Nawab brother (pvt.) Limited,
CLC 2019 1685 · Balochistan High Court
This case involved a dispute between a Quetta university and a private construction company over unpaid work. The company filed a claim, and both sides agreed to appoint an arbitrator to settle the matter. The arbitrator reviewed the evidence, rejected the university's counter-claim as unsupported, and awarded the company roughly 48 million rupees plus interest and costs, while disallowing a large portion of the company's original claim for lack of contractual support.
The university objected to the award in the trial court, but the objections were rejected and the award was confirmed. The university then appealed to the Balochistan High Court, arguing that its evidence and counter-claim had not been properly considered.
The High Court dismissed the appeal. It held that courts reviewing arbitration awards do not act as appellate courts and cannot re-examine evidence to look for errors unless such errors are clearly visible on the face of the award itself. Since the university could not point to any specific mistake or misconduct by the arbitrator, and the award was based on documented evidence, there was no legal basis to overturn it. However, the court did modify one part of the award, ruling that the arbitrator had no authority to grant interest on the award amount from the date of the award until actual payment, since this went beyond his powers.
This judgment reinforces the limited role courts play in reviewing arbitration awards, emphasizing finality and respect for arbitrators' decisions unless clear errors appear on record.
