CLC 2019 1291 · Balochistan High Court
This case concerned a family dispute over inherited land. The plaintiffs claimed they were entitled to a 1/7 share of property left by their ancestor and sought declaration, partition, and possession of the land. The trial court ruled in their favor and ordered the property divided, which the defendants then challenged before the Balochistan High Court through an appeal and revision petition.
The High Court found two major legal problems with the lower court's decision. First, part of the disputed land had been dedicated as a trust (waqf) for religious or charitable purposes. Under the law, any lawsuit concerning trust property of this kind requires prior permission from the Advocate General, and no such permission had been obtained here. Because of this, the trial court had no legal basis to decide the case in the plaintiffs' favor.
Second, the land was classified as "Shamilat Deh," meaning common village land. The Court explained that civil courts have very limited power over such land, and no individual share can be declared or awarded unless the land is formally partitioned by revenue authorities according to the ancestral shares of recognized proprietors. Ordinary residents, tenants, or occupants without such ancestral rights cannot claim a share.
Based on these findings, the High Court set aside the earlier judgments and decrees as unsustainable, allowing the revision petition. The ruling highlights important procedural safeguards protecting trust property and clarifies that village common land disputes must go through revenue authorities, not ordinary civil courts.
