CLC 2019 114 · Balochistan High Court

This case is about a land dispute between local residents (the appellants) in Zhob and the Pakistan Army over land used for military exercises like field firing and artillery practice. The appellants claimed they owned the land, inherited from their forefathers, and said the Army was wrongfully interfering with their possession and stopping them from using it. The Army relied on government notifications issued under a 1938 law that allowed the land to be used for military maneuvers and firing practice, and argued the appellants had no right to be there.

The trial court had dismissed the appellants' suit, but the Balochistan High Court overturned that decision. The court held that lack of formal government land-settlement records does not mean the land has no owner; ownership can be proven through other evidence, including prior court rulings and long possession. Importantly, the court clarified that the government notification only allowed temporary, limited use of the land for military exercises - it did not transfer ownership or create permanent rights for the Army. Once the exercises were over, residents were entitled to resume normal use of their land, and any continued interference by authorities after that would be illegal.

This ruling matters because it protects the property rights of local landowners against overreach by military or government authorities, clarifying that special-purpose land-use notifications cannot be used to permanently dispossess people of their land.
