CLC 2019 1096 · Balochistan High Court

This case involved a land dispute in Balochistan over roughly 14 acres of agricultural property. Two groups of people each claimed ownership: one side said their ancestors bought the land back in 1932 through an informal agreement, and that a later official land settlement in the 1940s had mistakenly recorded ownership under the other family's name. The other side, recorded as the official owners in revenue records, said they had merely lent four acres of the land to the first group in 1993 for six years so they could dig a tube-well and farm it, in exchange for a share of the crops.

The trial court initially dismissed the claim of the family seeking declaration and correction of records, but the appellate court reversed that and ruled in their favor. The matter eventually reached the Balochistan High Court.

The High Court sided with the recorded owners (the respondents). It held that an old, undated arbitration award—produced to support the other side's claim—was invalid because the attorney who agreed to it had no authority to do so, and the arbitration had bypassed the court entirely, making it legally worthless. The court also ruled that long-standing official revenue entries are presumed true unless strongly disproven, and that mere possession of land doesn't override documented ownership. It also clarified that the time limit for filing such suits starts when the other side formally denies ownership in their written reply, not earlier.

This judgment matters because it reinforces that official land records carry strong legal weight, and that informal agreements or arbitration without court approval cannot be used to override documented ownership.
