Raheem Bakhsh and another V. Bashir Ahmed and 4 others,

CLC 2018 967 · Balochistan High Court

This case involved a property dispute over land in Pakistan. The plaintiffs (Bashir Ahmed and others) filed a lawsuit seeking a declaration of ownership, an injunction, and correction of land records regarding property they claimed was ancestral and in their possession. The defendants (Raheem Bakhsh and another) contested the suit, denying the plaintiffs' claims in their written statement.

It later emerged that before the lawsuit was even filed, the defendants had secretly sold portions of the disputed land to third parties on three separate occasions. They did not disclose this sale in their written statement, effectively hiding it from the court. When the plaintiffs discovered this through revenue records, they applied to amend their suit and add the buyers as parties, which the trial court allowed. The trial court also issued a show-cause notice to the defendants for concealing facts, and since they failed to adequately respond, imposed a cost of Rs. 5,000 on them.

The defendants challenged this cost order before the High Court. The High Court dismissed their petition, finding no illegality in the trial court's decision. It held that hiding the prior sale amounted to misleading the court and could even be treated as contempt of court, but the trial court had already taken a lenient approach by only imposing a monetary penalty.

This case matters because it reinforces that parties must be honest and transparent with courts, and concealment of material facts can attract penalties or contempt proceedings.
