Naseebullah Khan Bazai V. Dr. Ummar Khan Babar and 2 others,
CLC 2018 841 · Balochistan High Court
This case is about whether a court judgment can be reversed after it was discovered that the person who won the case had hidden important facts from the court.
Dr. Ummar Khan Babar, a government officer, had filed a constitutional petition asking the Balochistan High Court to direct his promotion-related case to be processed. The High Court ruled in his favor on 30 August 2017. However, Naseebullah Khan Bazai, another officer who was senior to Dr. Babar and would be affected by this decision, filed a review application asking the court to reconsider its own judgment. He argued that he had not even been made a party to the original case despite having a direct interest in the outcome, and that Dr. Babar had concealed a crucial fact: he was facing a pending criminal case under the National Accountability Ordinance over alleged embezzlement of over 40 million rupees. Under the applicable promotion rules, an officer facing such pending criminal proceedings was not eligible for the promotion in question.

Since Dr. Babar had concealed a materially important fact affecting his eligibility, the judgment obtained was tainted. The court ruled that it has the inherent power to review its own orders in such circumstances, and since the original judgment had not yet been implemented, it recalled that judgment and dismissed the original petition entirely.
This matters because it reinforces the principle that court remedies cannot be secured through concealment or dishonesty, and that courts
