Abdul Hayee and 2 others V. State through Prosecutor-General Balochistan,

CLC 2018 581 · Balochistan High Court

This case from the Balochistan High Court dealt with an appeal by three men convicted of possessing unlicensed weapons and ammunition. Levies officials had stopped a vehicle carrying five rifles, a Kalashnikov, thousands of rounds of ammunition, and a revolver hidden in various parts of the car. The driver, Abdul Hayee, also had a separate revolver and live rounds on his person, along with a license belonging to someone else. All three occupants were tried; one, Muhammad Ayub, absconded during trial and was tried and convicted in his absence.

The court upheld the conviction of the driver, reasoning that since he was in control of the vehicle, he was legally responsible for what it contained, and the additional weapon found directly on him confirmed his role in concealing and transporting the arms. However, the court acquitted the other passenger, ruling that merely sitting in a vehicle where weapons are hidden does not prove knowledge or responsibility, and the prosecution had not shown he was aware of the concealed items.

Separately, the court set aside the conviction of the absconding accused, holding that trying and sentencing him without giving him a chance to be heard violated constitutional guarantees of due process and fair trial, as well as anti-terrorism law safeguards, amounting to condemning him unheard.

The case highlights important principles: possession/control determines criminal liability for concealed weapons, mere presence isn't guilt, and even absconders are entitled to a fair hearing before conviction.

عدالت نے ڈرائیور کی سزا برقرار رکھی، اس دلیل کے ساتھ کہ چونکہ گاڑی اس کے قابو میں تھی، اس لیے قانوناً وہی اس میں موجود اشی
