CLC 2018 511 · Balochistan High Court
This case concerns a long-running property dispute in Quetta over land that was originally leased to the predecessors of the private respondents. Years later, an unregistered 1995 lease agreement surfaced, reportedly giving the tenants certain rights, including a claim that the property could not be sold to anyone else without first offering it to them. Based on this, a court had earlier decreed that the owner must honor the agreement. Subsequently, the property changed hands through gifts between family members, and a new owner eventually obtained a court decree confirming his ownership. The original tenants then challenged that decree using Section 12(2) of the Civil Procedure Code, which allows a judgment to be set aside under specific legal grounds, and both the trial court and the appellate court sided with them, canceling the decree and the related property mutation.
The Balochistan High Court found that the lower courts had acted improperly by deciding the matter without framing proper legal issues or giving the parties a chance to present evidence on crucial points, especially regarding whether the unregistered lease was legally valid under the Transfer of Property Act, the Registration Act, and the Contract Act. Because these important legal and factual questions were never properly examined, the High Court set aside both lower court orders and sent the case back to the trial court to be decided afresh, with proper procedure. This case highlights the importance of due process and thorough legal examination before overturning property rights.
