Haji Abdul Wahid V. Abdullah and 5 others,
CLC 2018 459 · Balochistan High Court
Haji Abdul Wahid filed a suit against Abdullah and others seeking a mandatory injunction, recovery of mesne profit, and permanent injunction, claiming a share in the income of a flour mill business run on his family's property and rent arrears for shops and a godown. The defendants were in possession of the premises under an arrangement where they ran the flour mill business and were supposed to share income and pay rent to the plaintiff's family, but allegedly stopped paying after 1990.
Earlier, the plaintiff had filed an eviction petition which was dismissed, followed by an earlier suit for mesne profit and mandatory injunction. When he later filed a fresh suit for ejectment, the lower courts dismissed it, holding it was barred under Order II, Rule 2 of the Civil Procedure Code, which prevents a party from splitting claims arising from the same cause of action into multiple suits.
The Balochistan High Court disagreed. It held that the earlier suit concerned mesne profit and injunction, while the new suit concerned ejectment, a different cause of action that had not fully matured earlier. Since the defendant's possession was permissive (based on the business and rent arrangement) rather than wrongful, the claims were distinct, and the bar under Order II, Rule 2 did not apply. The court set aside the lower courts' orders and sent the case back for trial on merits, allowing the revision petition. This clarifies that procedural bars against repeat litigation apply only when the same cause of action is involved, not simply because related disputes involve the same
