CLC 2018 45 · Balochistan High Court
This case is about a housing society for retired railway employees in Quetta, which had leased about 47.77 acres of railway land in 1990 for building residential colonies. The society claimed that some individuals had wrongfully encroached on this land and asked the court for a declaration confirming its lawful lease rights, an injunction against illegal construction, and an order for demarcation of the property.
Instead of properly conducting a trial, the lower court appointed a Local Commissioner (a lawyer) to visit the site and report on the boundaries. Based solely on that report, the trial court decided the case without formally framing legal issues or giving both sides a real opportunity to present evidence. The appellate court upheld this decision without properly examining whether that process was fair.
The Balochistan High Court found this approach improper. It ruled that both lower courts had failed to follow correct legal procedure - they relied on an unexamined and objected-to report instead of holding a proper trial with evidence and arguments from both sides. This, the High Court said, caused a miscarriage of justice.
As a result, the High Court set aside the earlier decisions and sent the case back to the trial court, directing it to conduct proper proceedings, frame issues, and allow both parties a fair chance to present evidence before deciding the matter afresh. The case highlights the importance of following due process, rather than shortcuts, in resolving property disputes.
