CLC 2018 299 · Balochistan High Court
This case involved a dispute over inherited agricultural land between a brother and sister, the only surviving children of their deceased father. The daughter, Sehat Bibi, sued for a declaration that a mutation (land transfer record) in her brother's favor was fraudulent, seeking partition, cancellation of the mutation, and her rightful share. She claimed her brother had transferred their late father's land into his own name and then sold it to a third party without her knowledge, depriving her of her inheritance. The brother argued the land had been gifted or willed to him by their father during his lifetime, and that the sister's claim was filed too late and undervalued. Both the trial court and the appeals court had ruled against the sister.
The Balochistan High Court overturned these decisions. It found that the brother had failed to prove the alleged gift or will with any credible evidence, no witnesses were produced, and the mutation document did not even bear the father's signature. The court held that under Islamic inheritance law, both siblings were entitled to their proportionate shares of their father's estate, and one heir cannot claim sole ownership over others through an unproven gift. Since the property had already been sold, the court ordered the brother to pay the sister her rightful share from the sale proceeds within three months, allowing her to pursue enforcement if he failed to comply.
This case matters because it reinforces that inheritance claims cannot be defeated by unproven gifts or wills, and that all legal heirs are entitled to their due share under Sharia-based succession law.
