CLC 2018 1943 · Balochistan High Court
This case involved a long-running family property dispute in Quetta. A plot had originally been allotted to Abdul Karim, who built a house and shops on it. After his death, one of his sons, Raja Muhammad Sabir, got the entire property transferred into his own name through a settlement department order in 1971, rather than it being divided among all of Abdul Karim's legal heirs. Years later, the property was redeveloped into a shopping center and hotel, and Raja Sabir exchanged it with other parties for different properties and cash, who then sold part of it onward.
The other children of Abdul Karim sued, arguing they were co-sharers (joint owners by inheritance) and that the exchange deal was illegal since it ignored their shares. The trial court agreed and cancelled the exchange. On appeal, the High Court upheld this decision. It held that once a father dies, his children automatically become co-owners of his property, and each co-sharer is treated as having a stake in every part of the land until a formal partition occurs. The court also examined whether the later buyers could be protected under a legal principle (Section 41, Transfer of Property Act) that shields good-faith purchasers who took reasonable care before buying. However, since the buyers never claimed or proved they acted in good faith or investigated the sellers' ownership properly, this protection did not apply.
The ruling reinforces that property transfers ignoring rightful heirs' shares are void, and that buyers must verify ownership claims carefully to claim good-faith protection.
