Obaidullah Jan Barat and 2 others V. Speaker, Balochistan Assembly and 2 others,
CLC 2018 1650 · Balochistan High Court
This case concerns a petition by three elected members of the Balochistan Provincial Assembly who were suspended from attending the remaining sittings of the 2018 budget session. The suspension was ordered by the Presiding Officer, who was chairing the session in the Speaker's absence, after disorder occurred during proceedings. The petitioners argued the Presiding Officer had no authority to adjourn and then reconvene the sitting, that proper procedure was not followed, and that the suspension was politically motivated to stop opposition members from participating in the budget debate.
The Balochistan High Court dismissed the petition. It explained that under the Assembly's Rules of Procedure, a Presiding Officer nominated to chair in the Speaker's absence holds the same powers as the Speaker, including authority to adjourn sittings, reconvene them, and maintain order, even suspend members during grave disorder. The court clarified the difference between a "session" and a "sitting" and found the Presiding Officer acted within the rules. Importantly, the court held that under Article 69 of the Constitution, courts cannot question the internal procedural conduct of Assembly proceedings, only clear excess of jurisdiction, and the Presiding Officer enjoyed constitutional protection for regulating the House.
This ruling matters because it reaffirms the principle of parliamentary privilege and judicial restraint regarding internal assembly proceedings, limiting courts' power to interfere in how legislatures manage their own members and business.
