CLC 2018 1535 · Balochistan High Court
This case concerns a dispute over inherited property in Quetta. Muhammad Ameen owned land which, before his death, he transferred through a gift mutation to his three unmarried daughters, excluding his son Feroz. The father had earlier published a notice disowning his son, apparently over disobedience, and the defendants argued this justified cutting him out of inheritance. After the father's death, the son sued to have the gift mutation cancelled, seeking his rightful share of the property along with possession and partition.
Both the trial court and the first appellate court ruled in the son's favor, declaring the gift mutation invalid and holding that all legal heirs were entitled to their shares. The daughters challenged this before the Balochistan High Court.
The High Court upheld the lower courts' decisions and dismissed the revision petition. It held that disobedience is not a valid ground under Islamic law to disinherit a legal heir, and that a gift made specifically to deprive an heir of their rightful inheritance share is void, even though Muslims are generally free to gift property to anyone during their lifetime. The court noted that since this was a gift made in exchange for Rs. 200,000 (Hiba-bil-Iwaz), the son would have to return that amount to the daughters.
This ruling reinforces that parents cannot use gifts to bypass Islamic inheritance rules and punish heirs for perceived disobedience, protecting the fixed inheritance rights guaranteed under Islamic law.
