CLC 2018 1399 · Balochistan High Court
This case concerned a long-running dispute over agricultural land in Quetta that had originally belonged to a Hindu landowner and was treated as evacuee property after Partition. The government had allotted portions of this land to certain allottees in 1960-62, and the land was officially mutated in their names, though physical possession was never handed over. Separately, descendants of one Khan Bahadur Khudai Rahim claimed their ancestor had purchased the same land back in 1947, before Partition, through unregistered sale documents, and sought formal confirmation of that sale from the Custodian of Evacuee Property. This application was filed decades late, only against one of the two allottees, and without properly establishing the claimant's authority to act on the deceased purchaser's behalf. The Member, Board of Revenue rejected the request for confirmation of sale, and the purchaser's heirs challenged that rejection in the High Court.
The High Court dismissed the petition. It held that the application for confirmation of sale was filed well beyond the legally prescribed thirty-day period, that the allottees whose rights were affected had never been properly made parties or challenged through valid legal proceedings, and that no proper inquiry by the Custodian of Evacuee Property was shown on record. The court also noted that disputed factual questions like these cannot be resolved through constitutional petitions. It ruled that the original Board of Revenue decision was properly reasoned, and the purchaser's heirs lacked standing to pursue the claim at this stage, though it left open other appropriate legal remedies for them to pursue
