CLC 2017 699 · Balochistan High Court

This case involved a property dispute in Gwadar, Balochistan. A man named Syed Muhammad had won a court case in 2009 for declaration, possession, and other relief concerning certain land. Later, a person (Respondent No.4) who was not included as a party in that original lawsuit challenged the judgment, arguing it was obtained through fraud and misrepresentation, since he had rightful interest in the same land through earlier dealings that were concealed from the court. The trial court agreed, accepted his application, and cancelled the 2009 judgment and decree, restoring earlier property records. The petitioners (successors of the original winning party) challenged this cancellation, arguing the trial court decided the matter without properly examining evidence or holding a full hearing.

The Balochistan High Court upheld the trial court's decision to set aside the 2009 judgment, agreeing that there was sufficient documentary evidence showing concealment of facts and fraud, and that the challenger was indeed a necessary party who had been wrongly left out. However, the High Court found an error: once a judgment is cancelled under Section 12(2) of the Civil Procedure Code, the original lawsuit should be revived and reheard on its merits, with the challenger properly included as a party. Since the trial court had not done this, the High Court ordered the case sent back for a fresh, complete trial. This clarifies that cancelling a judgment for fraud doesn't end the case—it must be retried fairly with all rightful parties included.
