Malik Wali Muhammad and 40 others V. AC/SDM and Collector Saddar Sub-Division, Quetta and another,
CLC 2017 1637 · Balochistan High Court
This case involved a group of landowners near Hanna Lake in Quetta whose land was acquired by the government in 1994 under the Land Acquisition Act, 1894. The Collector fixed compensation rates for different types of land, but the landowners felt these rates did not reflect the true market value of their property. They asked for the matter to be referred to the District Judge, who upheld the Collector's valuation and rejected their claim for higher compensation. They appealed to the High Court, which also dismissed their case, and then to the Supreme Court, which sent the matter back to the High Court because the lower courts had not properly examined the documentary evidence (sale deeds and revenue records) the landowners had submitted.
On reconsideration, the High Court found that the landowners' own documents actually showed land values lower than what they were now claiming, undermining their case. It also noted that the trial judge had personally visited the site and found the land uneven, mountainous, and never cultivated, unlike other lands used for comparison. The court held that landowners can object to an award even after accepting compensation under protest, but in this instance the evidence still supported the original valuation. Finding the trial court's decision well-reasoned and free of legal error, the High Court dismissed the appeal, upholding the compensation originally awarded.
