State Through Special Public Prosecutor, Anti Corruption Establishment V. Allah Dina,
CLC 2017 1624 · Balochistan High Court
This case involved a criminal appeal by the State against the acquittal of a Patwari (revenue official), Allah Dina, who had been accused of colluding with a complainant's former business partner to fraudulently transfer land into other people's names. The complainant alleged that four land mutation entries were created using his forged signatures, and that the accused, a public servant, helped push through these fraudulent transfers. He was originally charged with criminal breach of trust, cheating, forgery, and corruption under the Pakistan Penal Code and the Prevention of Corruption Act, but the trial court acquitted him.
The State appealed this acquittal, but the Balochistan High Court upheld it and dismissed the appeal. The court found that the prosecution never got the complainant's disputed signatures examined by a handwriting expert, so there was no reliable proof the signatures were actually forged. It also noted that the disputed mutation entries had already been cancelled by revenue authorities on the complainant's own request, meaning the land transfers no longer had any legal effect. Additionally, a key witness who attested the mutation documents did not give evidence linking the accused to any wrongdoing.
The court reaffirmed that an acquittal carries a strong presumption of innocence, and appellate courts should not overturn it unless the decision is clearly unreasonable or contrary to evidence. Since the trial court's decision was well-founded, the acquittal stood. The case highlights how weak or incomplete evidence, especially the absence of expert verification, can be fatal to a corruption prosecution.
