This case involved a dispute over a shop at the Canteen Store Department (CSD) in Quetta Cantonment. Abdul Rehman claimed he had been running the shop under an agreement since 1997 and, due to old age, had his nephews help manage it. The CSD sent him a notice in January 2015 stating it had learned he had died and that whoever was running the shop was doing so illegally, ordering them to vacate. Rehman sued for a declaration that he was alive and that the eviction notice was unlawful, along with an injunction to stop interference with his business.
The CSD asked the trial court to reject the plaint under the Civil Procedure Code, arguing the suit had no valid basis since Rehman had violated his agreement, including by subletting the shop. The trial court agreed and rejected the plaint. On appeal, the Additional District Judge overturned this and sent the case back for a full trial with evidence from both sides.
The Balochistan High Court, hearing CSD's revision petition, sided with the original trial court. It held that the trial court had correctly examined the record and found the suit meritless, and that courts should dismiss such incompetent suits early to save time and resources. The High Court ruled the appellate court had wrongly interfered, set aside its order, and restored the trial court's rejection of the plaint. This case highlights how courts can screen out weak lawsuits early rather than letting them proceed to full trial.
یہ مقدمہ کوئٹہ چھاؤنی میں کینٹین سٹور ڈیپارٹمنٹ (سی ایس ڈی) کی ایک دکان سے متعلق تنازع پر مبنی ہے۔ عبدالرحمٰن کا دعویٰ تھا کہ وہ 1997ء سے ایک معاہدے کے تحت یہ دکان چلا رہا ہے اور بڑھاپے کی وجہ سے اس کے بھتیجے اسے دکان کے انتظام میں مدد دیتے ہیں۔ سی ایس ڈی نے جنوری 2015ء میں اسے ایک نوٹس بھیجا جس میں کہا گیا کہ ان کے علم میں آیا ہے کہ وہ انتقال کر چکا ہے اور جو بھی شخص اس وقت دکان چلا رہا ہے وہ غیر قانونی طور پر ایسا کر رہا ہے، اور اسے دکان خالی کرنے کا حکم دیا گیا۔ رحمٰن نے عدالت میں دعویٰ دائر کیا جس میں یہ اعلان طلب کیا گیا کہ وہ زندہ ہے اور بے دخلی کا نوٹس غیر قانونی ہے، اور ساتھ ہی اس کے کاروبار میں مداخلت روکنے کے لیے حکمِ امتناعی کی استدعا بھی کی۔
