CLC 2017 1170 · Balochistan High Court

This case arose after a wife filed for dissolution of her marriage through khula in a Family Court in Islamabad, after leaving her husband's home with their daughter. The husband responded not by contesting the case on its merits, but by filing a constitutional petition in the Balochistan High Court. He asked the court to declare Section 10(4) of the Family Courts Act, 1964 (a provision dealing with khula proceedings) as illegal and un-Islamic, to stop Family Courts from applying it, to direct the government to make laws consistent with Islam, and to transfer his wife's case from Islamabad to Quetta. He named the President, National Assembly, and Senate as respondents, believing they were responsible for the law.

The High Court dismissed the petition. It held that the husband had misunderstood constitutional procedure: the President could not be sued due to constitutional immunity, and Parliament's houses are not legal entities that can be made parties in such petitions. More importantly, the court ruled that it had no jurisdiction to decide whether a law is repugnant to Islamic injunctions. Under Articles 203D and 203G of the Constitution, only the Federal Shariat Court has the power to examine such questions, and other courts, including High Courts, are barred from doing so. The court also refused the transfer request since it had no authority over courts in Islamabad.

The case is a reminder that challenges to laws on Islamic grounds must go to the Federal Shariat Court, not ordinary High Courts.

ہائی کورٹ نے یہ درخواست خارج کر دی۔ عدالت نے قرار دیا کہ شوہر آئینی طریقہ کار کو غلط سم
