Mst. Parveen Khan V. Abdul Ghafoor and 2 others,
CLC 2016 932 · Balochistan High Court
This case is about a wife's claim for maintenance from her husband after their marriage broke down. Parveen Khan had sued her husband Abdul Ghafoor for unpaid dower money, dowry items, and maintenance for herself and their minor daughter, alleging she was mistreated and neglected. The husband denied cruelty, claimed she left his house on her own, said he had already divorced her, and disputed the dowry claims.
The trial court partly ruled in her favor, awarding her maintenance from 2010 through the divorce date and the Iddat period afterward. However, the husband appealed, and the appellate court reduced her maintenance entitlement, ruling she was only owed maintenance for the three-month Iddat period after divorce, not for the earlier years, since she failed to prove her husband had thrown her out of the house or treated her cruelly.
The wife then challenged this reduction before the Balochistan High Court, arguing an agreement between the couple entitled her to maintenance from whenever she left the house. The High Court disagreed. Under Islamic law principles (specifically Rules 277-278 of Muhammadan Law), a wife is only entitled to maintenance if she proves she was forced out due to her husband's cruelty. Since Parveen Khan couldn't prove this, the court upheld the appellate court's decision limiting her maintenance to the Iddat period only. Her petition was dismissed.
This case illustrates how courts apply Islamic legal principles requiring wives to prove cruelty or wrongful expulsion to claim ong
