Muhammad Ibrahim V. Niaz Muhammad,

CLC 2016 609 · Balochistan High Court

This case from the Balochistan High Court dealt with a landlord-tenant dispute over a house in Quetta. Niaz Muhammad, claiming to be the owner, filed for eviction of his tenant Muhammad Ibrahim, citing non-payment of rent and his own need for the house. Ibrahim denied being a tenant at all, claiming instead that he had purchased the property from a different person, Baz Muhammad, and that a case for specific performance of that sale was already pending in court. The Rent Controller sided with the landlord and ordered eviction, prompting this appeal.

The High Court overturned that decision. It held that before seeking eviction, a landlord must first clearly prove two things: that he actually owns the property, and that the person he wants evicted is genuinely his tenant. Simply having some entries in revenue records (mutation) in his favor was not enough, especially when ownership itself was disputed and a separate ownership case was pending. The court found no solid evidence that Niaz Muhammad owned the house or that Ibrahim had ever paid him rent.

The court set aside the eviction order and dismissed the case, ruling that such ownership disputes must first be resolved in a proper civil court with full evidence, rather than through summary rent-eviction proceedings. This matters because it reinforces that eviction cases cannot be used to sidestep genuine ownership disputes—landlord status must be firmly established first.
