CLC 2016 533 · Balochistan High Court

This case from the Balochistan High Court dealt with a woman, Rashida, who sued her relatives for her rightful share of inherited property left by her father, along with partition, possession, and correction of land records. During the case, her lawyer/attorney allegedly executed a "gift deed" transferring her share to her brother, and the trial court passed a preliminary decree based on this. Rashida claimed she was illiterate, never knew about or consented to this so-called gift, and only discovered she had been excluded as an heir after her relatives' appeal was decided.

The High Court ruled in her favor. It held that a valid Islamic gift requires a clear offer by the donor, acceptance by the recipient, and actual delivery of possession—none of which existed here. It also found that the power of attorney given by Rashida did not specifically authorize her attorney to make gifts or dispose of her property; such authority must be explicitly stated. Since no such power existed, the gift deed was ruled fake, fabricated, and illegal, making the preliminary decree legally worthless.

The court also clarified procedural points: a consent decree cannot be appealed, so filing a revision petition directly was proper, and the High Court can still intervene through revision when a lower court order is fundamentally void.

Ultimately, the court set aside the fraudulent decree, restored Rashida's inheritance rights, and ordered authorities to distribute the property fairly among all legal heirs according to Islamic inheritance shares. The case highlights protections against fraudulent property transfers, especially affecting vulnerable
