Aziz Jan V. Ayaz and others,
CLC 2016 1478 · Balochistan High Court
This case was about a man, Aziz Jan, who claimed he had bought agricultural land from another person through three agreements made in 1991 and 1993. He later discovered that the land had instead been transferred to someone else (respondent No.3) through official mutation entries, and eventually gifted further. He sued for specific performance of the sale agreements, cancellation of these mutations, and declaration of his ownership.
The trial court dismissed his suit, and the appellate court upheld that dismissal. Aziz Jan then filed this revision petition before the Balochistan High Court.
The High Court also ruled against him. It held that he had failed to properly prove the agreements to sell, since the required attesting witnesses were not produced in court, and testimony from the scribe who wrote the documents was not enough on its own. The court also noted that an admission made by one co-defendant (the seller's heirs) could not be treated as binding on the other contesting defendant, especially since the plaintiff himself had disputed the validity of the agreement in the framed issues. Additionally, no evidence was presented to show that the land transfers to respondent No.3 were fraudulent or that any revenue official acted improperly. Because of this lack of proof, the court found the plaintiff had no standing to challenge the mutations as forged.
This case highlights how strictly Pakistani courts require formal proof—like witness testimony—before enforcing property agreements, and that one defendant's admission cannot automatically bind others in a dispute.
