Abdullah Jan and another V. Bibi Almas Bano and 8 others,

CLC 2016 1465 · Balochistan High Court

This case involved a property dispute in Quetta where three respondents (Bibi Almas Bano and others) sued for possession of land through the Islamic law right of pre-emption, which allows certain persons to buy back property sold to an outsider. The case had already been remanded once before. After remand, the trial court tried to serve notice on the appellants but their address was incomplete. Instead of directing the plaintiffs to provide the correct address, the court ordered substituted service through newspaper publication. When the appellants still did not appear, they were proceeded against ex parte, and the suit was decided in the plaintiffs favor without their side being heard.

The Balochistan High Court found two major problems. First, the trial court failed to follow the proper legal procedure for substituted service, since such service can only be used after genuine efforts at normal service have failed, and no such effort or report was shown here. The failure to serve the appellants was due to the plaintiffs own negligence in providing wrong or incomplete addresses. Second, on the merits of the pre-emption claim, the plaintiffs evidence was vague, lacking proper description of the property and failing to state the exact date and time they learned of the sale, or when they performed the required legal formalities (Talb-i-Muwathibat and Talb-i-Ishhad) needed to claim pre-emption rights.

Because of these serious defects, the High Court set aside the earlier judgment and decree and dismissed the suit, allowing the appeal. The case highlights the importance of proper service of notice and strict compliance with pre-emption requirements under
