Sabzal and 9 others V. Deputy Commissioner/Collector and 2 others,

CLC 2015 97 · Balochistan High Court

This case involved a dispute over land acquired by the Government of Pakistan in 2006-2007 in Gwadar for a Joint Defence Complex. The landowners (petitioners) received compensation for their land without raising any objections at the time, and possession was handed over to the government. However, in March 2010, years later, they filed a reference with the Deputy Commissioner/Collector, challenging the valuation of their land and alleging irregularities in the acquisition process. The Collector rejected this reference as time-barred, since it was filed long after the legal deadline.

The landowners then challenged this rejection in the High Court, arguing that the Collector had no authority to reject their reference and should have forwarded it to the District Court for a decision on merits.

The Balochistan High Court dismissed the petition. It held that under the Land Acquisition Act 1894, a person objecting to an award must file a reference within six weeks of the award if they were present or served notice, or within six months if they were not served notice. Since the petitioners had accepted compensation without objection and filed their reference years late, without even seeking condonation of the delay, the Collector was legally entitled to reject it as time-barred.

This judgment clarifies that strict limitation periods apply to land acquisition disputes, and landowners who accept compensation without objection, then delay challenging the award, risk losing their right to contest it in court.
