CLC 2015 794 · Balochistan High Court

This case is about a family land dispute in Balochistan. Two sisters, Shah Bibi and Gull Bibi, claimed they had inherited land from their grandfather but had to leave the area due to drought. They alleged that while they were away, another family (the petitioners) wrongly got themselves recorded as owners in the revenue records. The sisters sued for a declaration that they were the rightful owners, correction of the land records, and a permanent injunction stopping the other side from interfering with the land. Notably, they did not ask for possession, claiming they already had it.

The case went through multiple rounds in the trial court, appellate forums, and even a previous revision before the High Court, with conflicting decisions along the way. Eventually, during these proceedings, the plaintiffs sought to amend their suit to add a claim for possession, since evidence suggested the other side was actually occupying the land with houses and a tube-well built on it.

The High Court ruled that courts have wide power to allow amendments to pleadings at any stage, including during appeals or revisions, as long as the amendment is necessary to resolve the real dispute and does not change the fundamental nature of the case. Since a plea for possession was closely tied to the original claim, the court allowed the amendment, subject to payment of costs, and sent the case back to the trial court to frame proper issues and decide the matter on merits. This ruling clarifies how flexible amendment rules can be used to ensure disputes are fully and fairly resolved.
