CLC 2015 752 · Balochistan High Court

This case involved a long-running dispute over agricultural land (Khasra Nos. 119 and 120) in Mouza Bhagyar, Balochistan. The plaintiffs sued for a declaration, correction, and cancellation of a land mutation entry, plus a permanent injunction, claiming the land was wrongly recorded in the government's name and later fraudulently transferred to certain defendants. The trial court (Qazi's court) ruled in favor of the plaintiffs, but the appellate body (Majlis-e-Shoora) reversed that decision and dismissed the suit. The petitioners then challenged this reversal before the Balochistan High Court.

However, the plaint itself revealed that the same subject matter had already been litigated: an earlier suit over the same land had been decreed in 1991, an appeal against it was dismissed, and a subsequent application to reopen the matter (under Section 12(2) of the Civil Procedure Code) had also failed all the way up to the Supreme Court. Given this, the High Court found that the fresh suit was not legally competent to begin with, since the matter had already been conclusively decided.

The Court held that when examining a plaint, courts must independently verify whether a suit is legally maintainable based solely on the plaint's own contents, and must reject it at the outset if it is barred by law. Since the trial court failed to do this, the suit should never have proceeded. The High Court dismissed the revision petition, emphasizing that courts must not allow relitigation of already-settled disputes.
