Bakhtiar V. Nasrullah and 12 others,

CLC 2015 385 · Balochistan High Court

This case involved a dispute over 40 acres of land in Mouza Padua, Tehsil Hub, District Hub, Balochistan. The recorded owners of the land had allowed certain individuals (including Bakhtiar) to cultivate it, with an understanding that the cultivators would share produce with the owners. A dispute arose when the cultivators began unauthorized construction and stopped sharing produce, leading the owners to seek repossession, including through proceedings under the Illegal Dispossession Act.

Bakhtiar claimed he had actually purchased the land through an unregistered agreement for Rs. 70,000 and sought declaration of ownership, while the landowners filed a separate suit seeking possession. The trial court ruled against Bakhtiar and in favor of the landowners, prompting two connected appeals before the Balochistan High Court.

The High Court upheld the trial court's decision. It held that a mere agreement to sell does not itself transfer ownership or create legal title in immovable property; only a registered sale deed can do that under the Registration Act. Since Bakhtiar's agreement was unregistered and its execution was not properly proved (the witnesses to it were never produced), it could not establish ownership. The court also noted that mutation records carry a presumption of truth, supporting the original owners' claim. The appeal was dismissed, with the occupiers ordered to vacate and pay compensation.

This judgment reinforces the legal principle that unregistered sale agreements cannot override formal, registered ownership records in Pakistan.
