Muhammad Khan V. Ch. Abdul Rahim and 2 others,
CLC 2015 343 · Balochistan High Court
This case is about a dispute over "pre-emption," an Islamic law right that lets a neighbouring landowner claim first option to buy adjoining property when it is sold. Muhammad Khan claimed that his neighbour's land, sold to another buyer for Rs. 18,00,000, should instead go to him because he exercised his pre-emption rights properly. To succeed in such a claim, the law requires the buyer to perform certain formal steps called "Talbs" immediately upon learning of the sale, and to prove this was done exactly as described in the original court filing (the plaint).
The trial court had dismissed Khan's suit, and he appealed to the Balochistan High Court. The High Court examined his evidence and found that his testimony and witness statements about when he learned of the sale and how he performed the required Talbs did not match what he had originally stated in his pleadings. There were also contradictions within his own evidence. Since pleadings and evidence must align, and a party cannot introduce new facts not mentioned in the original pleadings without formally amending them, the court held that Khan failed to prove he had properly performed the legal requirements for a pre-emption claim.
As a result, the High Court upheld the trial court's decision and dismissed the appeal. The case highlights the importance of consistency between pleadings and evidence in pre-emption lawsuits, and the strict procedural requirements for such claims under Islamic law as applied in Pakistan.
