Government of Balochistan through Additional Chief Secretary, Planning and Development Department V. Messrs Enterprise and Development Consulting (Pvt.) Ltd.,

CLC 2015 1743 · Balochistan High Court

This case involved a contract dispute between the Government of Balochistan and a private consulting firm, Enterprise and Development Consulting (Pvt.) Ltd., hired for a resource management project. When a payment dispute arose over about US$23,794, the company sought arbitration under the Arbitration Act, 1940, as provided in their contract. The trial court appointed an arbitrator, who eventually issued an award in the company's favor, and the trial court made this award a rule of court, effectively enforcing it.

The government challenged this, arguing the trial court had acted beyond its powers and ignored the specific arbitration procedure laid out in the contract when appointing the arbitrator.

The Balochistan High Court agreed with the government. It held that before appointing an arbitrator, a court must first determine whether it even has jurisdiction over the dispute, and must follow the method for selecting an arbitrator specified in the agreement itself. Since the trial court appointed an arbitrator unilaterally, without properly considering the contract's arbitration clause or its own jurisdiction, the resulting award was void from the start. The court set aside the trial court's order, rejected the award, and sent the case back for the trial court to first decide whether it had authority to appoint an arbititor outside the contract's own procedure.

This case matters because it reinforces that courts and parties must strictly follow agreed contractual procedures for resolving disputes through arbitration, rather than taking shortcuts.
