Bibi Babo V. Muhammad Aslam and another,
CLC 2015 1555 · Balochistan High Court
This case involved a property dispute over a house in Quetta between Bibi Babo (the plaintiff) and Muhammad Aslam (the defendant). Bibi Babo claimed she owned the house, backed by revenue records (a mutation entry in her name), and alleged that while she was away in Karachi caring for her ailing husband, Aslam broke in and illegally occupied it. Aslam argued he had lived there for 28 years, paid the utility bills, and that an earlier complaint Bibi Babo filed under the Illegal Dispossession Act had already been dismissed.
The trial court sided with Aslam, dismissing her suit for possession, reasoning that his long possession and utility bills proved his claim, and that her case was also time-barred and vaguely described.
The Balochistan High Court reversed this decision. It held that a mutation entry in revenue records carries a legal presumption of truth, which Aslam failed to disprove. Utility bills, the court said, can show who lived in a property but cannot establish legal ownership, especially when there is a recorded owner. The court also found the property was adequately identified, the earlier dismissal of her Illegal Dispossession Act complaint didn't give Aslam any ownership rights, and her suit was filed within the legal time limit. The appeal was allowed, and the house was awarded to Bibi Babo. The ruling reinforces that mere long-term possession or paying bills cannot defeat the rights of a documented, true owner.
