CLC 2015 1315 · Balochistan High Court

This case concerns a civil revision petition filed in the Balochistan High Court by three women (Mehr Khatoon, Naz Bibi and Sharatoon) challenging earlier decisions of a local court and appellate forum that had rejected their property claim. The petition was filed in 2006 through an advocate who, instead of submitting a proper power of attorney (Wakalat Nama), merely gave an undertaking that he would file it later. That authorization never came.

Over the following years, the case dragged on, two of the original petitioners died, their legal heirs were added, and different lawyers appeared for the petitioners without ever formally proving they were authorized to represent them. When notices were finally sent directly to the petitioners, some heirs appeared and even claimed that certain original petitioners had never actually filed the suit or authorized any legal action at all.

The High Court examined the law on how advocates must be appointed, particularly Order III, Rule 4 of the Civil Procedure Code, which requires a written, signed authorization before a lawyer can act for a client. Since no such document was ever filed, the court held that the advocates who appeared were not properly authorized, meaning the petitioners were never legally represented before the court.

As a result, the court ruled that the revision petition, having been filed by an unauthorized person, was not maintainable and dismissed it. The case highlights the importance of formal, written authorization for lawyers to represent clients in court.
