CLC 2015 107 · Balochistan High Court

This case involved a land dispute in Gawadar, Balochistan, between relatives descended from a common ancestor named Aboo. The appellants claimed their branch of the family had been wrongly recorded with fewer shares of ancestral land than they were entitled to. They first filed a suit in 2006 to correct this, but withdrew it unconditionally in 2007. Later, in 2009, they filed a fresh suit claiming that on the very day they withdrew the first suit, the parties had actually reached an out-of-court compromise agreeing to transfer them additional land shares, and that compensation from government land acquisition based on that agreement was wrongfully kept by the other side.

The High Court dismissed the appeal and upheld the trial court's rejection of the suit. It held that if such a compromise genuinely existed, the plaintiffs should have disclosed it when withdrawing their first suit rather than withdrawing unconditionally. Because they withdrew the earlier suit outright, filing a new suit on a cause of action that already existed at that time was barred under the Civil Procedure Code. The court also found that the person who allegedly signed the agreement on behalf of the other side was not properly authorized to do so, and the plaintiffs failed to legally prove the agreement itself.

This case reinforces an important procedural principle: parties cannot withdraw a lawsuit outright and later file a new one based on facts or agreements they knew about but failed to disclose earlier.
