Muneer Ahmed V. District and Sessions Judge, Lasbella at Hub and others,
CLC 2015 1053 · Balochistan High Court
This case from the Balochistan High Court involved disputes arising from local government council elections in Gaddani, District Lasbela, held in December 2013. Candidates who narrowly lost their contests filed election petitions before an Election Tribunal (the District and Sessions Judge, Lasbela), challenging vote counts, including allegations that certain votes were wrongly rejected or forcibly cast.
While these election petitions were still pending final decision, the Election Tribunal issued administrative letters or notifications instructing election authorities on how to treat certain contested votes, effectively deciding key factual issues without formally hearing the affected parties or issuing a proper judicial order.
The petitioners argued this was unfair and unlawful, since such consequential decisions were made behind their backs, through executive letters rather than a proper judicial process with notice and hearing.
The High Court agreed. It held that orders with such serious legal consequences cannot be passed through informal administrative communications while formal adjudication is still pending, and doing so violates natural justice. It ruled that such void orders cannot be allowed to stand, as illegality cannot be perpetuated. It also allowed additional affected persons to be added as parties to ensure everyone impacted had a chance to be heard. Ultimately, the Court set aside both impugned orders as illegal, without jurisdiction, and void from the outset.
The case highlights the importance of fair procedure and due notice before decisions affecting people's electoral rights are made, even by tribunals handling local government election disputes.
