CLC 2014 878 · Balochistan High Court
This case involved a criminal revision petition against a trial court order allowing the complainant to summon a Judicial Magistrate as a witness under Section 540 of the Criminal Procedure Code. The Magistrate had earlier conducted an inquiry into the incident and formed an opinion about the accused's alleged negligence, based on statements from witnesses who had already testified before the trial court.
The petitioners argued that the Magistrate's evidence would be hearsay, inadmissible, and not binding on the trial court, and that summoning him would serve no real purpose since the same witnesses had already been examined at trial.
The Balochistan High Court agreed with the petitioners. It explained that an "inquiry" and a "trial" are legally distinct processes, and a Magistrate's opinion formed during an administrative inquiry is not evidence of fact but merely an opinion, which is inadmissible except in specific circumstances under the Qanun-e-Shahadat Order. The court held that convictions must rest only on evidence properly recorded by a competent court, not on opinions formed elsewhere. It also clarified that Section 540 gives courts discretion to summon witnesses only when genuinely necessary for justice, not to fill gaps in the prosecution's case or prolong proceedings.
Since the Magistrate's testimony would add nothing admissible or essential, the court set aside the trial court's order and dismissed the application. This ruling reinforces limits on when courts can call additional witnesses and clarifies the distinction between inquiry and trial evidence.
