Muhammad Ayub V. The State,
CLC 2014 805 · Balochistan High Court
This case involved a man accused of murder, robbery, and dacoity in Quetta. According to the prosecution, he and a companion, armed with weapons, robbed a student of his motorcycle, shot and injured the student, and also fatally shot his own companion during the incident. He was caught on the spot by locals and handed to police. He was charged under sections of the Pakistan Penal Code dealing with murder and robbery, along with a provision of a special law dealing with property offences.
The accused sought bail, arguing that he had reached a compromise (compensation/forgiveness agreement) with the victim's side, and that courts should treat all murders as compoundable under Islamic law regardless of the circumstances.
The Balochistan High Court rejected the bail application. It held that while compromises can sometimes be a factor considered in deciding bail, they cannot by themselves entitle an accused to bail as a matter of right, especially in serious non-compoundable offenses like murder committed during robbery or dacoity. The law specifically bars compounding such offenses. The court also noted that the accused was caught red-handed with the weapon, and that this was a serious crime involving both murder and an attempt to kill another victim, making bail unjustified on the merits.
This ruling matters because it clarifies that a private compromise between an accused and a victim's family does not override criminal law protections meant to serve the wider interest of society, particularly in violent crimes.
