Mrduman-e-Malle Zai Nida Kahol through Haji Saleh Muhammad and others V. Marduman-e-Killi Khudai-e-Rahim Sadezai (Shai) through their Elders and others,

CLC 2014 426 · Balochistan High Court

This case involved a land dispute between two tribal communities in Chaman, Balochistan, over a piece of land situated between properties belonging to Nida Kahool and Ahmed Kahool tribes. The appellants (Malezai Nida Kahool) claimed the land was theirs, citing an old 1945 judgment from the Additional District Magistrate that had ruled in favor of their predecessors and led to the respondents vacating the disputed land. They argued that the respondent tribe later re-encroached on the property while the appellants were away due to border tensions, and that a tribal jirga failed to resolve the matter, prompting the lawsuit for declaration, injunction, possession, and correction of revenue records.

The trial court dismissed the suit, and the High Court upheld that dismissal. The court found that the 1945 judgment did not specify the boundaries of the property or confirm it was the same land now in dispute, nor did it establish that possession had actually been handed over to the appellants. The appellants failed to prove exactly when they were dispossessed or that they had prior possession, which is required when seeking both declaration and possession under the law. Witness testimonies were also contradictory regarding measurements and timelines. Since the suit was filed too late under the Limitation Act and lacked basic details like property boundaries, the court ruled it was time-barred and unsubstantiated. This case reinforces that possession claims must be backed by clear, consistent evidence and filed within legal time limits.
