Abdullah V. Provincial Government through Secretary Board of Revenue and 3 others,

CLC 2014 285 · Balochistan High Court

This case involved a dispute over a piece of land in Kharan, Balochistan. Abdullah, who ran a private school, claimed he had purchased a plot of land for Rs. 50,000 from one Javed Masih to build a school building. With government financial assistance, a school building was constructed, but the District Administration later refused to hand over the building to him, prompting him to file a civil suit for declaration and injunction.

The trial court (Qazi, Kharan) dismissed his suit, and his appeal to the Majlis-e-Shoora, Kharan was also dismissed. He then approached the Balochistan High Court through a civil revision petition.

The High Court upheld the lower courts' decisions. It found that Abdullah's claimed sale of the land was illegal and invalid, meaning no clear title had actually passed to him. Since he lacked proper title, he was not entitled to sue for declaration or possession of the property. The court also noted that a lease document he relied on had never been properly presented or exhibited as evidence during trial, so it could not now be considered.

The court emphasized that when lower courts have properly examined the evidence and reached consistent factual conclusions, the High Court's revisional powers do not allow it to reweigh that evidence simply because another view might be possible. Finding no legal errors or misreading of evidence, the court dismissed Abdullah's revision petition, meaning the school building remained outside his ownership claim.
