Abdullah and another V. Mst. Farzana,
CLC 2014 1463 · Balochistan High Court
This case is about a landlord-tenant rent dispute decided by the Balochistan High Court under the West Pakistan Urban Rent Restriction Ordinance, 1959. The landlady, Mst. Farzana, sought eviction of her tenants from a small shop (Cabin/Khoka) in Quetta, claiming they had stopped paying monthly rent since January 2012. The tenants argued they had actually paid rent for an earlier period through a receipt, that the landlady later refused to accept rent, and that whatever default existed should be treated as a condonable "first default" under the law.
The trial court (Rent Controller) had already ruled in the landlady's favor, ordering the tenants to vacate for wilful default in rent payment. On appeal, the High Court upheld this decision. It found that the tenants never actually produced the rent receipt they claimed existed during the trial, nor questioned the landlady about it when she testified—merely attaching a document to the appeal later was not valid proof. The Court also rejected the argument that occasional lump-sum rent payments created a habit of flexible payment timing; tenants were legally required to pay monthly, and failing to deposit rent within 60 days of it falling due amounted to wilful default.
This judgment reinforces a key rent-law principle: tenants must strictly prove rent payments through proper evidence at trial, and irregular or delayed payment practices do not excuse legal default, reaffirming landlords' strong protection against non-paying tenants.
