Yar Muhammad V. Provincial Transport Authority, Balochistan through Chairman and 3 others,

CLC 2014 1433 · Balochistan High Court

This case dealt with a dispute over a bus route permit in Balochistan. The petitioner, Yar Muhammad, held Route Permit No.2 of 2007 for a route between Aeri and Sibi. A rival operator challenged his permit and timetable before the Provincial Transport Authority (PTA). Earlier, the PTA itself had ruled in the petitioner's favour, directing the Regional Transport Authority to let him operate his bus and issue a timetable. That order went unenforced, and the petitioner had to approach the High Court to get it implemented. Later, however, the PTA Chairman passed a fresh order cancelling not just the disputed permit but four other route permits belonging to the petitioner, without conducting any inquiry or examining the official record, relying instead on verbal claims made by the opposing party.

The High Court found this cancellation order legally flawed. It held that under the Provincial Motor Vehicles Ordinance, 1965, only the Transport Authority that originally granted a permit can cancel or suspend it, and only after following proper procedure, including inquiry through the concerned authority. The PTA had no jurisdiction to cancel permits based on unverified assertions without record or investigation, especially when it conflicted with its own earlier order favouring the petitioner.

The court set aside the cancellation order and sent the matter back to the Transport Authority to be decided afresh in accordance with law. The case highlights the importance of due process, proper inquiry, and consistency in administrative decisions affecting people's livelihoods.
