Nasrullah V. Muhammad Rasool and 7 others,
CLC 2014 1323 · Balochistan High Court
This case is about a property dispute involving the Islamic law doctrine of pre-emption, which allows certain people (like neighbours) to claim the first right to buy land when it is sold, provided they follow strict legal formalities. Nasrullah claimed this right over land adjacent to his property after it was sold and later exchanged between several respondents. To succeed, a pre-emption claimant must make specific demands called "Talbs," including an immediate assertion of the right as soon as he learns of the sale, known as Talb-e-Muwathibat.
The trial court dismissed Nasrullah's suit, finding he had not properly made this demand. On appeal, the Balochistan High Court agreed. It found serious inconsistencies between what was stated in the plaint and what Nasrullah and his witnesses testified in court, including conflicting dates about when he learned of the sale, missing details about witnesses present at the time, and a mismatch between the pleaded version of events and the evidence given later. The court held that a party cannot introduce a new version of facts during trial that was not part of the original pleadings. Since the plaint did not properly describe an immediate, witnessed assertion of the right, the claimed demand did not meet the legal requirements of Talb-e-Muwathibat.
As a result, the High Court dismissed the appeal, reaffirming that strict compliance with pleading requirements and the correct legal procedure is essential for a valid pre-emption claim.
